1. Introduction

Welcome to Wipeout Pest Control. These Terms & Conditions (“Terms”) apply to your use of our website and any pest control services (“Services”) we provide. By booking or using our Services, you agree to these Terms.

2. Application of Consumer Law

• If you are a Consumer (acquiring Services for personal, domestic, or household use), the Consumer Guarantees Act 1993 (CGA) and Fair Trading Act 1986 (FTA) apply and cannot be excluded, except as allowed by law.
• If Services are acquired for business purposes, you agree that the CGA does not apply.

3. Our Commitment to You

• We guarantee that our Services will be delivered with reasonable care and skill, fit for the agreed purpose, and completed within a reasonable time if no specific timeframe is set.
• We comply with the FTA and will not make false, misleading, or unsubstantiated claims about our Services.

4. Pest Control Specifics

• While we use best-practice methods and approved products, results may vary depending on the type of pest, level of infestation, and property conditions.
• We do not guarantee complete or permanent eradication of pests. Follow-up treatments may be required.
• Customers must follow all pre- and post-treatment instructions provided. Failure to do so may reduce treatment effectiveness and limit our liability.
• In some cases, treated areas may require restricted entry (e.g., up to 4 hours) after application. This will be advised at the time of service.

5. Customer Responsibilities

• Provide safe access to the property.
• Prepare the premises as advised (e.g., cleaning, covering, or removing certain items).
• Inform us of pets, children, or sensitive medical conditions that may be affected by treatments.
• Ensure compliance with health and safety requirements during and after treatment.

6. Pricing, Invoicing & Payments

• Severity or duration of the infestation
• Distance of travel
• Type of property (residential, commercial industrial)
• Size of the property (Square footage, number of room/floor)
• Access requirements or restrictions (e.g., pets, tenants, business hours)
• Location (some areas may have specific pest issues)
• All prices will be advised prior to service.
• Full payment is required on or before completion of the service unless otherwise agreed in writing.
• Late payments may incur interest and/or recovery costs.
• Cancellations: A minimum of 24 hours’ notice is required. Cancellations within 24 hours may incur a fee.

7. Liability

• To the maximum extent permitted by law, Wipeout Pest Control is not liable for:
• Loss or damage caused by failure to follow our instructions.
• Indirect, special, or consequential loss (e.g., loss of income).
• For Consumers, our liability under the CGA is limited to re-supplying the Service or refunding the cost, unless otherwise required by law.

8. Termination

We may suspend or cancel Services immediately if you breach these Terms or create unsafe conditions for our staff.

9. Privacy

• We collect and handle your personal information in line with the Privacy Act 2020.
• Your information is used only for providing Services, invoicing, and communication.
• We do not share your information with third parties except as required by law.

10. Dispute Resolution

• If you are unhappy with our Services, please contact us first so we can resolve the issue.
• If unresolved, disputes may be referred to mediation or the New Zealand Disputes Tribunal.

11. Changes to Terms

We may update these Terms from time to time. The latest version will always be available on our website. Continued use of our Services indicates acceptance of updated Terms.

12. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes will be dealt with in New Zealand courts.
